3. Professional rules

The following professional rules may apply, to the extent relevant:

• Berufsordnung für Rechtsanwälte — BORA;
• Rechtsanwaltsvergütungsgesetz — RVG;
• professional rules of the lawyers of the European Union — CCBE;
• professional rules of the country of origin;
• other applicable professional and disciplinary rules.

The current German professional rules are available through the Bundesrechtsanwaltskammer and the Rechtsanwaltskammer München.

4. Scope of services

LEXONYX focuses on international business structuring, structural and factual tax / VAT / PE interfaces, banking readiness, Source of Funds / Source of Wealth, substance and corporate governance.

Ukrainian-law advice is provided directly within the professional authorisation of Advokat (Ukraine). Where a matter requires a conclusion on German law, German taxation or another reserved German professional matter, the relevant conclusion is provided or confirmed by an appropriately qualified Rechtsanwalt, Steuerberater or other German professional.

For other jurisdictions, jurisdiction-specific legal, tax and regulatory conclusions are provided or confirmed by appropriately qualified local professionals. LEXONYX coordinates the cross-border project and integrates confirmed conclusions into the overall structure.

Sum insured:
At least EUR 250,000 per insured event. The maximum aggregate indemnity for all insured events occurring within one insurance year is at least four times the minimum sum insured.

Territorial scope of insurance:
Europe and Turkey, subject to the terms and exclusions of the current insurance policy. Coverage does not extend, in particular, to activities conducted through offices or branches in other countries, advice concerning non-European law other than Turkish law, or representation before non-European courts.

7. Engagement and conflicts of interest

Before accepting an engagement, LEXONYX carries out a conflict-of-interest check.

Submitting an enquiry through the website, by email or through a contact form does not itself establish a client relationship. A client relationship is created only after the engagement has been expressly accepted and the relevant engagement agreement has been concluded.

Until acceptance has been confirmed in writing, LEXONYX assumes no responsibility for monitoring deadlines, taking procedural steps or carrying out other legally significant actions.

8. Confidentiality

Documents and information are handled in accordance with applicable confidentiality, data-protection and professional-secrecy requirements.

The scope of the engagement, the applicable confidentiality regime and the arrangements for involving external advisers are set out in the client agreement.

Documents are not shared with local counsel, tax advisers or other external professionals without an appropriate legal basis and an agreed need within the scope of the project.
